Proving that he is about as conversant with American civics as his foreign accent would indicate, Arnold Schwarzenegger has essentially stated that the will of the people means nothing to him.  Michael Rothfeld and Tony Barboza writing at the Los Angeles Times report:

Gov. Arnold Schwarzenegger on Sunday expressed hope that the California
Supreme Court would overturn Proposition 8, the ballot initiative that
outlawed same-sex marriage. He also predicted that the 18,000 gay and
lesbian couples who have already wed would not see their marriages
nullified by the initiative.

‘It’s
unfortunate, obviously, but it’s not the end,’ Schwarzenegger said in
an interview Sunday on CNN. ‘I think that we will again maybe undo
that, if the court is willing to do that, and then move forward from
there and again lead in that area.’

Unfortunately, most Americans are as ill-informed as Governor Steroids, so they won’t understand how staggering this statement is.  But here is a quick lesson — one I just rendered here — for Schwarzenegger.

Governor, amending the Constitution is the legal way to alter it, while negating an amendment through judicial fiat is an illegal way to preserve it.  The people have spoken, and you, Governor, are proposing that an unelected oligarchy of Black Robes should thwart their will and make a mockery of republican government.

Let me be clear, it’s bad enough that Schwarzenegger is advocating an abomination such as faux marriage, but while that’s immoral (the most significant factor, of course), it’s not illegal.  But to then also advocate thwarting the will of the people as expressed through a legal process should be an impeachable offense.  In the least, the people of Ka-lee-fornia should recall this incompetent man as they did his predecessor.

Governor, regardless of how you feel about a given issue, it’s your job as a Ca. public official to uphold your state’s constitution.  And this document, mind you, is shaped by the people, not black-robed oligarchs.

Yes, the muscle man is a terminator, all right.  He’s currently involved, along with most public officials, in terminating our constitutional republic.

You just don’t get how a Supreme Court works or what its function is, do you? Or, maybe you do and are just doing your usual thing, which is somewhat distant from what you call the Truth.

I am outraged about this!!! Judges are not to legislate law but to interpret the law! I am sick and tired of the majority vote being overturned. Does our vote mean nothing? This is a very slippery slope.I think it’s time to impeach the governor if he thinks so little of our rights as voters.Thomas Jefferson once said that the only mistake in our constitution was that there was no oversight of the judical system. Boy was he right!!! I have never been a militant person but I for one have had enough. It’s past time that we as voters unite and end this once and for all!!!!!!!!!!

O-please and just askin’; can you refute what Selwyn said or can you just name call and intimidate with sarcasm? There is no refuting his point that what Governor Schwarzenegger is trying to do is unconsititutional and the role of a supreme court is not to overturn the will of the people simply based on the fact they don’t agree with it. If that were the role of courts, then why vote on anything? What if the Suprem Court of the U.S. decided they didn’t like Obama and thought his election violated some inaliable rights therefore decided to overturn it and appoint John McCain as president? I suspect you would be up in arms over that and call foul.

Actually Joe, if you look at it, the Supreme Court did just that in 2000. How soon do we forget?

I knew that would be your only resort of refutation and in fact the supreme court did not do that. They ended the insane amount of recounts that went on for over a month when it became clear Al Gore was willing to recount until they found enough to elect him president. Recount rules were followed and the supreme court put a stop to it after reasonable efforts were made to see who the victor was. Keep living in the past though; apparently it’s working using the liberal playbook that hasn’t changed for 60 years.

If the the people of California voted to reinstate slavery, would that be okay? Or voted to leave the Union, is that fine with you? “Will of the People” and everything…they would have “Spoken,” so it’s okay…right? There should be no checks on that? How about burning Jews? Wait…Am I getting a little too close to home?
